Causes of Divorce

The Causes of Divorce per the Article 212 of the Family Code:

 1. The attack of one of the spouses against the life of the other, or their sons, daughters, stepsons or stepdaughters.

 2.  The cruel physical or psychic treatment if it makes impossible the peace and the domestic calmness.

 3. The extramarital sexual relationship.

 4. The proposal of one of the spouses to prostitute the other.

 5. Inclination of the husband or the wife to corrupt or prostitute their sons, daughters, stepsons or stepdaughters, or the coexistence of their corruption or prostitution.

 6. The absolute abandonment from the part of the husband of his duties of husband or father, and from the part of the wife, of her duties of wife or mother, if at the time to file the demand of divorce has passed six (6) months, at least counted from the day in which the term was originated the cause, unless it is the abandonment of a pregnant woman, in which case the term will be of three (3) months.

 7. Substance abuse.

 8.  Alcohol addiction.

 9. The separation “in fact” for more than two (2) years, even though they live under the same ceiling.

 10. The mutual consent of the spouses.
