As per the Law #1 of January 5th, 1984, that regulates the Trust Normative in Panama, and adopts other dispositions. (G.O. 19,971 of January 10th, 1984). Estudio Jurídico Araúz will provide you all the advice and guide regarding Trust constitution.

Trust constitution is a juridical act in which one person being called Settlor transfers goods to a person called Trustee to administrate those goods or dispose them in favor of the Trustee or beneficiary, which can be the settlor himself. The entities of the Public Law could hold its own goods on a trust and acts as trustees of them to develop their purpose, through a declaration made with the law formalities.

A trust can be constituted over certain goods or over all or part of a patrimony. The will to constitute a trust must be declared expressly and written. In consequence, the verbal, implicit and presumed expressions won't value as a trust. A trust can be constituted for any purpose that can't violate the moral, laws or public order. The trust can be pure and simple or being a condition or deadline subject.

The private interest foundations are tax free when its incomes are generated outside Panama, and its address can be changed at any time from or to another jurisdiction. The foundations must be constituted as non-profit entities as a minimum patrimony of ,000.00.

The Foundation Certificate, incorporated in a protocol through a Public Deed, has to be registered in the Public Registry, but the regulations don't require to be registered, and they are maintained as a private document.

The Regulations include the relevant information, and pertinent confidence. The law also has the option to designate a protector or/and auditor and another supervisor entity, to guard the Foundation Counsel steps (the Foundation Administrative Division that can be a juridical entity or at least three natural people designated as president, secretary, and treasurer).

Also, as per the law, the assets transferred to the foundation are constituted in a patrimony separated from the founder(s) just as any other person(s) or entity(entities) that contribute to the foundation, and these can't be disputed in hereditary issues, defining clearly on this way as facing the legal precept about mandatory heritage, existing in some other jurisdictions.
